Wegovy is brand-name semaglutide made by Novo Nordisk, and it is one of only three brands that currently fit both tracks of the GLP-1 litigation: the stomach-injury track (MDL 3094) and the NAION sudden vision-loss track (MDL 3163), both pending in the Eastern District of Pennsylvania before Judge Karen S. Marston. Marin & Murphy is currently accepting Ozempic (GLP-1) gastroparesis and NAION cases.

Wegovy fits both tracks — and that is the first thing to know

The GLP-1 litigation is not one case. It is two separate federal proceedings with two different injuries, two sets of medical proof, and two different lists of medications. Which brand you took decides which door is open, and Wegovy opens both.

• Stomach-injury track. The referral criteria for gastroparesis and gastric-obstruction claims are limited to brand-name semaglutide — Ozempic, Wegovy, or Rybelsus. Wegovy qualifies. Tirzepatide and dulaglutide products (Mounjaro, Zepbound, Trulicity) do not meet these criteria for the stomach track.
• NAION vision-loss track. The criteria here are broader and cover brand-name Ozempic, Wegovy, Rybelsus, Trulicity, Mounjaro, and Zepbound. Wegovy qualifies here too.

Compounded or generic semaglutide — the kind sold through many med spas and telehealth services during the shortage years — does not currently meet the criteria for either track. If you are not certain which you had, that is an extremely common answer and not a reason to stay silent. Say so, and let us look.

Where Wegovy cases are being litigated

Federal stomach-injury cases were centralized on February 2, 2024, when the Judicial Panel on Multidistrict Litigation created MDL 3094, In re: Glucagon-Like Peptide-1 Receptor Agonists (GLP-1 RAs) Products Liability Litigation, transferring 17 actions to the Eastern District of Pennsylvania. That court’s product list names Ozempic, Wegovy, Rybelsus, Trulicity, and Mounjaro, and Case Management Order No. 18 (August 23, 2024) puts gastroparesis, ileus and intestinal obstruction, cholecystitis, and severe nausea and vomiting in scope.

NAION cases are somewhere else. On December 15, 2025, the Panel created a separate MDL 3163 for those claims, centralizing 20 actions before the same judge; Wegovy is named in that transfer order. New Jersey did the same at the state level: by Supreme Court order of October 16, 2025, two separate multicounty litigations — gastrointestinal and NAION — both in Bergen County before Judge Gregg A. Padovano.

What the FDA adverse-event data shows — and what it does not

Wegovy shares its active ingredient, semaglutide, with Ozempic and Rybelsus, so FDA records most of these reports at the ingredient level rather than the brand level.

As of the July 30, 2026 data refresh, FDA’s FAERS system held 82,911 total reports and 36,179 serious reports for semaglutide, including 3,558 coded as impaired gastric emptying, 1,166 for intestinal obstruction, 632 for ileus, and 631 for optic ischaemic neuropathy, the term FAERS uses for NAION.

Reports submitted to FDA are not verified and do not establish causation; they are voluntary, can be duplicated, and rise and fall with news coverage and litigation.

One published analysis is specific to this brand. In March 2026 the British Journal of Ophthalmology published a disproportionality analysis of more than 30 million FDA reports finding the NAION reporting signal roughly five times stronger for Wegovy than for Ozempic despite the identical active ingredient — a difference the authors attributed at least partly to differing patient populations and reporting behavior rather than to any pharmacologic difference.

What regulators have said about semaglutide and vision loss

On July 3, 2024, JAMA Ophthalmology published a Massachusetts Eye and Ear cohort study of more than 17,000 patients reporting that patients prescribed semaglutide for weight management were more than seven times as likely to develop NAION, and diabetic patients more than four times as likely. That study started this branch of the litigation.

On June 6, 2025, the European Medicines Agency’s safety committee concluded NAION is a very rare side effect of semaglutide medicines — Ozempic, Rybelsus, Wegovy — affecting up to 1 in 10,000 people, and recommended adding it to European product information. The United Kingdom and Australia have followed. As of today, the US label still carries no NAION warning. That gap is a fact about the paperwork, not about you: there was nothing on your label to read.

Who may qualify

• Stomach injuries (gastroparesis or gastric obstruction): brand-name Wegovy, Ozempic, or Rybelsus (not compounded or generic semaglutide); a gastroparesis diagnosis confirmed by a gastric emptying study, or a gastric obstruction confirmed by objective testing; diagnosed while taking the medication or within about 30 days of stopping; a related emergency-room visit or hospital admission; a diagnosis made before December 31, 2024; and age 75 or under at intake.
• NAION (sudden optic-nerve vision loss): brand-name Wegovy, Ozempic, Rybelsus, Trulicity, Mounjaro, or Zepbound; an actual NAION diagnosis made while taking the medication or after stopping; and some degree of permanent vision impairment.
• The gastric emptying study. In August 2025 the judge overseeing MDL 3094 ruled that gastroparesis claims must rest on properly performed objective gastric-emptying testing rather than symptoms alone. That is the court’s documentation requirement, not anyone’s opinion of your illness. Most people told they have gastroparesis were never sent for the test — a gap in how the condition is ordinarily diagnosed. “I’m not sure what tests I had” is a real answer, and we can help you find out what your records show.
• Not your doctor. These claims are against the manufacturer, Novo Nordisk — not your prescriber, pharmacy, or clinic. In many of these cases the prescriber’s records are the most useful evidence a claimant has.

Where the litigation actually stands today

Earlier than most advertising suggests. There is no trial date and no bellwether pool in either MDL. The current gate in the stomach-injury track is a Rule 702 hearing underway September 14 through 18, 2026, covering general causation for gastroparesis and for ileus and obstruction along with preemption and warning adequacy. Nothing about causation has been decided. In the NAION track, the court granted early cross-cutting motion practice on July 2, 2026 — the same front-loaded template, roughly two years behind.
