Is there an Olympus scope settlement yet?

Because these cases are individual, value is set case by case rather than by a settlement matrix. The factors that drive it are the same ones a jury would hear: the severity and duration of the infection, hospitalization and procedures, permanent harm, lost income, and the strength of the link between the scope and the infection in the medical record. A confirmed CRE or sepsis infection with a long hospitalization sits far above a mild infection that resolved with outpatient antibiotics.
