What Is the Current Status of the Olympus Scope Lawsuit in 2026?

No Olympus scope MDL has been filed or is pending as of April 2026. The JPML docket does not list any pending Olympus scope consolidation petition as of this writing. However, the litigation is active and moving toward coordinated resolution on a confirmed timeline. Individual cases are proceeding in federal and state courts. In mass tort litigation generally, a large number of related federal cases can later be consolidated before a single judge for coordinated pretrial proceedings. No such consolidation has been ordered in the Olympus scope litigation, however, and whether one is sought or granted is not something any firm can promise.

Olympus scope cases are being filed and litigated as individual lawsuits in federal and state courts. There is currently no MDL and no class action. Olympus Urgent Field Safety Notice — 2 Deaths, 5 Injuries

Olympus issued an Urgent Field Safety Notice on October 14—17, 2025, disclosing 2 deaths and 5 injuries linked to inadequate cleaning of its endoscope accessories. The UFSN specifically acknowledged that prior cleaning and reprocessing protocols were insufficient to prevent contamination, and required facilities to implement 10x magnification inspection during reprocessing.
